1. Acceptance of Terms

By placing an order with Toothful Secrets — whether through our website, WhatsApp, or any other channel — you agree to these Terms of Service. Please read them carefully before purchasing.

These terms are governed by the laws of Kenya. Any disputes will be resolved under Kenyan jurisdiction.

2. Our Products

Toothful Secrets crafts artisan chocolate spreads, frozen treats, chocolates and desserts using pure, functional ingredients. Our products:

• Contain no added processed sugars unless otherwise stated.
• Contain no synthetic preservatives.
• Are made in small batches and may vary slightly between productions.
• Are perishable — shelf life and storage instructions are provided on each product.

Product images are as accurate as possible. Minor colour or texture variations between the image and the actual product may occur due to the artisanal nature of our process.

3. Ordering

Orders can be placed via our website or WhatsApp. An order is confirmed once you receive a confirmation message from us. We reserve the right to cancel or refuse any order at our discretion — for example, if a product is out of stock or if we suspect fraudulent activity.

Prices are listed in Kenyan Shillings (KES) and are inclusive of any applicable taxes. Delivery fees are calculated separately at checkout.

4. Payment

We accept M-Pesa and card payments processed securely through Pesapal. Payment is required in full before an order is prepared and dispatched. We do not store payment card details.

If a payment fails or is disputed, we will contact you via the phone number or email provided at checkout to resolve the issue.

5. Delivery

We deliver across Nairobi and Kiambu County. Delivery fees and zones are detailed on our Delivery Info page. Delivery dates and time slots are selected at checkout — we will do our best to honor your chosen slot, but unforeseen circumstances may cause delays.

We are not liable for delays caused by circumstances beyond our control, including traffic, adverse weather or force majeure events.

Please ensure someone is available to receive your order. For perishable items, we cannot leave orders unattended. If delivery fails due to no one being available, redelivery fees may apply.

6. Perishable Goods

Our products are fresh and perishable. Upon delivery:

• Spreads should be refrigerated immediately and consumed within 7–14 days.
• Frozen treats should be placed in the freezer immediately upon receipt.
• Chocolates and desserts should be refrigerated and consumed within 5–10 days.

We are not responsible for product deterioration resulting from improper storage after delivery.

7. Refunds & Returns

Due to the perishable nature of our products, we are unable to accept returns. However, if your order arrives damaged, incorrect, or of unsatisfactory quality, please contact us within 24 hours of delivery via WhatsApp or email with a photo of the issue.

We will assess each case individually and offer one of the following resolutions:

• A replacement product on your next delivery.
• A store credit for a future order.
• A partial or full refund at our discretion.

We will not issue refunds for change-of-mind purchases or where the product was stored incorrectly after delivery.

8. Allergies & Dietary Information

Ingredients are listed on each product page. Our products are made in a kitchen that handles nuts, dairy, and cocoa. While we take precautions, we cannot guarantee products are free from cross-contamination.

If you have a severe allergy, please contact us before ordering so we can advise appropriately.

9. Intellectual Property

All content on this website — including text, images, logos, brand names and recipes — is the property of Toothful Secrets and is protected by Kenyan and international copyright law. You may not reproduce, distribute or use our content without prior written permission.

10. Limitation of Liability

Toothful Secrets shall not be liable for any indirect, incidental or consequential damages arising from the use of our products or services beyond the value of the order in question. Our total liability is limited to the amount paid for the specific order giving rise to the claim.

11. Changes to These Terms

We may update these terms from time to time. Any changes will be posted on this page with an updated date. Continued use of our website or placing an order after changes are posted constitutes acceptance of the revised terms.
